When she was just 16 years old, Fox Varian underwent a trans-affirming surgery called top surgery, which removed her perfectly healthy breast. Now 22, she no longer recognizes the contrast with her physiology, but has become the first detransitioner to win a medical malpractice lawsuit against those who irrevocably altered her body.

On January 30, Varian was awarded $2 million in damages, with a jury in Westchester, New York holding both her psychologist, Kenneth Einhorn, and her plastic surgeon, Simon Chin, legally responsible for the so-called “medical care” they performed on the teenager, who claimed to have been a boy at the time.

Independent journalist Benjamin Ryan was one of the few reporters present at the trial. Epoch reporter Stacey Robinson also covered the case, posting that when the verdict was announced, X-Varian “crying and hugging his mother.”

Ryan described the three-week trial as “riveting and at times devastating,” adding of his coverage: “With the entire case, including all court records, sealed, my furious note-taking during the trial may be the only way the public will learn the details of this case.”

Fox Varian sued a community psychologist and plastic surgeon in Westchester, New York, over the sex-reassignment mastectomy she underwent when she was 16 years old.

Lawyers representing Varian said Einhorn “drove the train” in counseling the then-teenage Varian, and accused the psychologist of “planting the idea in Fox’s head” that she needed to deal with her apparent gender dysphoria by permanently changing her body with a double mastectomy.

Varian’s mother, Claire Deacon, said during the trial that she had opposed the surgery, but eventually gave in because she feared her daughter would commit suicide without undergoing the irreversible procedure, which transgender surgery supporters often say.

“This guy kept pushing so emphatically that I felt like I couldn’t make good decisions,” Deacon testified. “I think it was an intimidation tactic. I don’t think there was any malicious intent. I think he believed what he was saying, and he was very wrong.”

The outcome of this case caused a huge reaction on the Internet.

Robbie Starbuck, the director of War on Children, predicted that “more people will be brought to justice and the floodgates will open,” adding of X: “What was done to these children was a crime against humanity. We must eradicate this unforgivable evil from the face of the earth. It must never happen again. The damage done to these children is heartbreaking.”

Prisha Moseley, a detransitioned woman who is suing the medical professionals who forced her to undergo transgender-affirming surgery when she was a minor, responded to the ruling by saying, “I hope justice prevails!”

Notably, Mr. Moseley told CBN News about his story. Looking back, she said the medical help she received was “a lie and a scam” and, like many others, discovered trans people on the internet as a struggling teenager.

“I was 15 years old when it started, and at 16 I started Depo-Provera treatment to stop my periods, and at 17 I started testosterone treatment,” she told CBN. “Then, just a year later, when I was 18, I had both breasts removed.”

She said doctors gave her “false hope” that having transgender-affirming surgery would dramatically improve her life.

Commenting on the outcome of Varian’s case, British freelance columnist Sonia Soda called the ruling “hugely important,” noting that more lawsuits will follow, and saying it is “likely to fundamentally change the approach of American medical professionals to surgically altering the healthy bodies of children who are questioning their gender.”

And conservative columnist Stephen Miller predicted, “This is how it all ends.”
