On Friday (April 4), a British court found a retired Christian woman guilty of violating abortion clinic “Buffer Zone,” where she provided a consensual conversation.
Magistrate Poole’s court has ordered a clinical scientist who has declared 64-year-old Livia Tossichtzivolt to be conditional discharged for two years and retired £20,000 (US$26,218) for two charges in 2023 for two days of violating the Public Space Protection Order (PSPO).
Tossici-bolt held a sign outside the Bournemouth clinic saying, “Speak here to speak here” according to the Alliance Defending Freedom (ADF) International.
In a conditional discharge, the prisoner must either comply with the conditions set by the court or face the possibility of a prison sentence. The prosecution fees £20,000, which Tossici-bolt has been ordered to pay, is the average salary for almost six months in the UK.
The incident occurred in June 2023 when local governments Bournemouth, Christchurch and Poole Councils imposed a fixed penalty notice against Tossichbolt. The council alleged that she violated a PSPO that prohibits “representation of abortion or disapproval” and fined her.
Tossici-bolt refused to pay the fine, claiming that she had not violated the zone and had the legal right to provide a consensual conversation under Section 10 of the Human Rights Act. She will have to pay £20,000 prosecutor fees by May 31st.
At a court hearing, council officials said Tossa Tivolt violated the PSPO for “several reasons.” He considered “the view of life with her, his own previous interactions, complaints received, and signs she held,” as reported by ADF International.
ADF International’s attorneys argued that the board did not provide evidence that Tossici-bolt was “observed by a service user or other form of harm.”
District Judge Aura Austin admitted the indication that he “did not mention pregnancy, abortion or religious issues.” And it was heard that council officers admitted that Tosci Boldt showed no indication of threatening or harassing anyone, but that council officers still found it reasonable to believe that the PSPO was bleached.
After the hearing, Toscizbolt called the outcome of a lawsuit that follows the “dark days in Britain.”
“I hadn’t protested, and I didn’t harass or interfere with anyone,” she said. “What I did was to provide consensual conversations in public as well as my basic rights, but the courts guilty of me: freedom of expression is a state of crisis in the UK.
Toschtzibort vows to continue fighting for free speech, not just for herself but for all the British, and she is considering the next step after the verdict.
“If we allow this precedent for censorship, the right to freely express ourselves is not safe,” she said. “With ADF International’s support, we will consider all legal options.”
ADF International has previously mentioned the incident, with several people showing their willingness to Tossici-bolt to engage in the conversation. The legal counsel at ADF International Lorcán Price commented that anyone who cares about freedom of speech should care about the buffer zone.
“A Christian woman was convicted of merely offering to chat on public roads in the UK,” Price said. “This ruling should go beyond the shadow of doubt and show all reasonable people that the ‘buffer zone’ of abortion facilities is not compatible with a free society. We now support Livia in considering all legal options. ”
The UK Act of 2023, the Civil Service Act, 2023, allows local governments to set up censorship buffer zones outside abortion clinics. The Act prohibits the impact of “a person’s decision to access, provide, or promote the provision of abortion services.”
